Breaking The Rental Agreement

If you do not reach an agreement, you are still required to pay compensation, but the landlord must apply to the local court for the amount of compensation to be fixed. If your landlord is forced to rent your unit at a $25 discount $US to insure a replacement tenant, they may be entitled to $25,$US per month for the remaining term of your contract. However, if your landlord can re-lease your unit for more than you paid, the extra money they will earn during the remaining months of your contract can be applied or „offset” liable to any other money you owe your landlord for unpaid rent or damage. There are a number of legal reasons for terminating a lease that vary slightly in each state and territory, but you usually need to make an order to your local jurisdiction for them to apply. Without a legal reason, the termination of your lease could be treated as a termination of the lease. You should check your individual lease to see if it contains details on how these fees are charged. If no break fee is indicated, you are nevertheless obliged to pay the refund of losses caused by the early termination of the contract, including the loss of rent. In NSW, laws introduced in 2010 meant that landlords could either include fixed rental fees in the lease, or the lessor could choose to use the old system in which the tenant was asked to pay for losses (the system existing in other states and territories). If you sign a fixed-term lease agreement, sign a binding contract that states that you pay the rent indicated for a minimum period. Ned Cutcher, speaking as a politician at the NSW Tenants Union, told us that breaking a lease is certainly not something you should do lightly.

The balance of power is usually with the owner in Australia`s overheated rental market. Long-term leases are virtually unknown and rent-raising limitations are rare.
